Booking General Terms and Conditions
These Terms and Conditions are provided by Travel Hiatus, which operates as an independent travel planning agency. All bookings are made through Travel Hiatus and may include references to “we,” “us,” or “our.” These Terms govern your access to and use of the services we offer, including our website (collectively, the “Services”).
Your access to and use of the Services is conditional upon your acceptance of and compliance with these Terms. If you do not agree to these Terms, please refrain from using our Services. You consent to our use of personal data in accordance with our Privacy Policy. If you are booking on behalf of others, you confirm that you have the authority to do so and are authorized to disclose their personal details to us, including any relevant health information or dietary requirements. You must be over 18 years of age and accept financial responsibility for the booking on behalf of all individuals listed.
Our Services include arrangements made with third-party suppliers. Please note that we are not responsible for the offerings of these third parties. As an independent travel agent, we facilitate connections with travel industry suppliers, including accommodations, meals, transportation (ground, water, and air), and recreational activities (collectively referred to as “Tour Companies”).
We do not supervise the operations of these Tour Companies and cannot be held liable for the accuracy of the information they provide, any changes in rates or schedules, or the quality of services rendered. We disclaim any responsibility for the actions or negligence of these Tour Companies and make no warranties, express or implied, regarding their services. It is the responsibility of the Tour Companies to comply with applicable laws and to ensure the safety and adequacy of the services they provide.
Products & Use by Travel Hiatus:
Travel Hiatus retains full ownership and intellectual property rights of all custom itineraries, travel packages, and related products created and delivered to our customers. While we grant you, the customer, a non-exclusive license to use these products for your personal travel purposes, it’s important to understand the limitations of this usage.
You are welcome to use the itinerary as you see fit for your own travel, and you may share it with friends and family members who may be traveling with you. However, you are strictly prohibited from selling, reselling, or commercially exploiting any itinerary, travel package, or product provided by Travel Hiatus. Additionally, you may not publish, distribute, or make publicly available any part of our products on the Internet, social media, or any other public platform without our express written consent.
Furthermore, you are not permitted to claim ownership or authorship of any itinerary, travel package, or product delivered to you by Travel Hiatus. These materials are provided for your personal use only and remain the intellectual property of Travel Hiatus.
Any violation of these terms, including unauthorized sale, publication, or claims of ownership, will be treated seriously. Travel Hiatus reserves the right to take appropriate legal action to protect our intellectual property and business interests in such cases. We kindly ask that you respect the time, effort, and expertise that goes into creating these custom products by adhering to these usage guidelines.
Client/s Identity Information:
We take the handling of your personal identity information very seriously to ensure the accuracy and validity of all travel documents. It is crucial that you provide accurate and complete personal details when communicating with us. This includes your first, middle, and last names, as well as dates of birth and any other relevant information.
We strongly advise you to double-check all provided information to avoid any discrepancies that could result in invalid travel documents. If you notice any errors or omissions, please inform us immediately so we can make the necessary corrections. Please be aware that changes to your personal information may incur additional fees, depending on the nature and timing of the adjustments required.
Travel Visas, Documents & Passport, & Health Requirements
It is the traveler’s sole responsibility to ensure they have all necessary travel documents, including a valid passport with a validity period of at least six months beyond the trip’s end date and any required visas or immigration requirements needed for your itinerary’s destination.
We strongly recommend checking the entry requirements for your destination from the official website of your passport country. While we can provide general information and essential assistance, we are not responsible for obtaining your visas or other travel documents.
You, being the client bear full responsibility for ensuring compliance with all passport, visa, immigration, and health requirements for your travel. Neither our company nor any suppliers we work with as agents will be held accountable if you are unable to travel or face any losses due to your failure to meet these essential travel formalities and regulations.
We recommend consulting with your doctor and checking official government websites for the most current recommended health information.
Please note that we are unable to provide health or vaccine advice for any destinations. Additionally, whether you are speaking with me or a member of my team, we cannot discuss our personal health, vaccination status, or any health-related matters.
Travelers must also comply with all health requirements, including vaccinations and medical certificates, as mandated by the destination country or transit points.
Cancellation and Refund Policy
- Consultation charges are non-refundable under any circumstances.
- Any itinerary packages delivered to a customer are non-refundable under any circumstances.
DISCLAIMER
This section is important for you to look over, and we suggest you read it carefully. As explicitly stated in these Terms, we do not give you any warranties, representations, guarantees, or conditions for our services, express or implied.
Traveling to certain international destinations may involve increased risks. By providing information about these locations, we do not guarantee that visiting them is safe, advisable, or free from risk, and we are not liable for any losses that may arise from such travel.
We are not responsible or liable for the actions or omissions of any third parties and their services, including those to whom we may have referred you. It is your responsibility to assess the suitability of any third party you engage with and to review and agree to their terms and conditions.
Limitation of Liability
Carefully read throughly the following: Travel Hiatus provides travel planning services with the utmost care and diligence. However, it is crucial that clients clearly understand and acknowledge the inherent risks associated with travel. By booking and purchasing a package from Travel Hiatus, you agree to the following terms:
You, the client, expressly understand and accept that travel involves risks to yourself, your family, friends, spouse, children, or any other individuals participating in the travel plans. These risks may include, but are not limited to, physical injury, emotional distress, sickness, death, damage to property, or loss of belongings and valuables.
Travel Hiatus, its representatives, employees, and affiliates shall not be held liable or sued for ANY loss, damages, or negative outcomes resulting from your travel experiences. This includes, but is not limited to, emotional distress, physical injury, sickness, death, damage to property, or loss of belongings and valuables.
By agreeing to these terms, you, your family members, or any legal representative acting on your behalf waive the right to sue Travel Hiatus, its representatives, employees, or affiliates or make any claim regarding injury, damage, or loss of life that may occur during or as a result of your travel.
THIS RELEASE OF LIABILITY IS INTENDED TO BE EFFECTIVE EVEN IF THE INJURY, LOSS OF LIFE, OR DAMAGE RESULTS FROM TRAVEL HIATUS’S NEGLIGENCE.
By proceeding with your booking, you acknowledge that you have read, understood, and agreed to these terms, accepting full responsibility for any risks associated with your travel plans. We are here to help create lifelong memories as you embark on new adventures; however, please understand that acts of unforeseen circumstances are beyond our control.
Acknowledgement of Travel Risk:
Participants understand that travel comes with inherent risks, regardless of the destination. These risks encompass a wide range of potential dangers, including but not limited to natural events such as extreme weather conditions, geological hazards, and environmental changes. Participants recognize that they may face threats from global health crises, localized disease outbreaks, political instability, and social unrest.
Additionally, navigating difficult terrain and traveling by air, land, or sea can present significant challenges.Participants are aware that international travel often involves exposure to high altitudes, unpredictable weather patterns, and limited access to immediate medical assistance, particularly in remote areas where evacuation may be difficult. Encounters with local wildlife and unfamiliar environments may also pose unforeseen dangers.
Travel Hiatus, along with its staff, partners, and affiliated service providers, cannot control or eliminate these risks. By proceeding with their travel arrangements, participants voluntarily accept these risks and agree not to hold Travel Hiatus, its employees, or any associated service providers liable for any adverse events that may arise as a result of these inherent travel risks.
Privacy Policy
Travel Hiatus respects your privacy and will handle your personal information with confidentiality. Your information will be used solely to plan and book your trip and will never be sold to external companies. While private details exchanged between us through email are strictly between yourself and Travel Hiatus, in the event of an email hack which is out of our control, whether on your end or ours, resulting in your personal information being shared online, Travel Hiatus cannot be held liable under any circumstances. We strongly encourage you to take necessary precautions to protect your email account and personal information.
